Nature's Own Photography is dedicated to providing you high quality, low cost photos that capture the true personality of you and your family. We do not provide limitations on your use of your photos as many photographer's do. You may print and share your photos as you wish without additional cost. Below are the conditions of this agreement.
Any and all rights to proofs, final or sample prints, remain the property of the Client and the Studio. Electronic versions of the photos may be printed, copied, or distributed by the Client to friends and family but may NOT be sold, auctioned, or advertised as photos taken by anyone other than Nature’s Own Photography. The Studio holds all proprietary rights to these photos and may be used for advertising, display or any other purpose thought proper by the Studio. If at any time either party wishes to sell any of these photos to a third party written consent must be obtained and commission provided to the other party, prior to the sale. If an agreement can not be reached prior to the sale the transaction must be stopped until legal mediation can complete an agreement.
If Photographer cannot perform this Agreement in whole or in part due to a fire or other casualty, acts of God or nature or terror, or other cause beyond the control of the parties or due to Photographer's illness or injury, then Studio will refund any payment to the Client(s) but shall have no further liability with respect to this Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of Photographer. Client(s) agree that if an entire photo shoot cannot be replicated, reenacted or repeated for the purpose of a re shoot and limits Studio's liability to the amount paid under this contract.
It is understood and agreed that no other photographer will be allowed to photograph or take pictures at the photo shoot while the Photographer is working.
On signing of this agreement by both parties hereto, the Studio will reserve the time agreed upon and will not make another reservation for the specific time frame. For this reason, all deposits are non-refundable even if the date is changed or if the photo shoots becomes cancelled for any reason.
All parties to be included in photos must be ready for their photos at set time. The photographers are not responsible for delays in or inability to complete these requested photos due to inaccessibility of participants.
Photos can be taken at any location of your choosing. Additional trip charge may be added if location is more than 20 miles from Magnolia TX (.55 per mile). Customer is responsible for securing permission for location shots, if necessary.
If a building is included in the photo (buildings must be distinguishable) a signed release by the property owner is required.
It should be understood by all participants in these photos that their photos may be used in advertising, display or any other purpose thought proper by the Studio and that no compensation will be provided. It should also be made clear to all participants that their photos may end up published on the internet. You, the Client, will be responsible for any adverse reactions or causes related to these actions if any shall arise. If any of your participants have issue with these terms they may complete an “opt out” agreement. These participants will be responsible for notifying the photographer after each photo that they are in so those photos can be removed from publication but still be provided to the Client.
Photo shoots are scheduled from time of arrival to time of departure of Nature's Own staff. Additional time can be purchased prior to the day of the event for $50.00 per hour. If additional time is required at the event/shoot the cost is $75.00 per hour, if the schedule for Nature's Own staff permits. Food and drink should be provided for staff for photo shoots over 1.5 hours.
The Studio agrees to provide two photographers for the allotted time for each portion of the shoot (unless otherwise agreed upon). Photos will be digitally enhanced (lighting adjustments, color enhancements) and placed on a secured website within 2 weeks from the date of the shoot A CD or DVD will be sent to you within 4 to 6 weeks of the final shoot of the event with all photos included.
NOTIFICATION OF CHANGES
These terms and conditions may be modified without notice. If we change anything in this policy it will be posted on our website, www.naturesownpics.com/terms.html.
